Examples of Successfully Resolved Cases

Erie County Supreme Court:
 
  • Jury verdict for wrongful death of wife and mother against two surgeons for failing to consider and employ non-surgical techniques to address cancer patient’s small bowel obstruction before undertaking risky surgery resulting in fatal complications.
     
  • Jury verdict against oral surgeon for failing to obtain a proper pre-operative history from patient who was taking a medication which depressed his immune system.  Patient suffered a massive infection resulting in facial disfigurement.
     
  • Jury verdict against Obstetrician and Gynecologist who broke an improperly sized suture needle during surgery and couldn’t retrieve the end portion. We produced expert testimony refuting the defense claim that the fragment was encapsulated by scar tissue and couldn’t move or cause pain.
Niagara County Supreme Court:  
 
  • Jury verdict in favor of man who fell through a second story hospital window while delirious from fever. Award made against hospital for failure to properly restrain or supervise him after becoming aware that he was disoriented, agitated and wanted to leave.
Federal Court, Western District of New York:
 
  • Court award to man who had leg amputated against Veterans Administration Hospital based upon vascular surgeon’s failure to consider arterial by-pass surgery before infection progressed to point that amputation was necessary. Award made following non-jury trial.
Erie, Niagara, Cattaraugus, Chatauqua and Wyoming County Supreme Courts:
 
  • Multiple confidential settlements of personal injury and wrongful death malpractice actions against physicians, podiatrists, dentists, hospitals and nursing homes, many of which were for seven and eight figure amounts.
